    Facts Sahil, a child of 10 years of age, find a gold coin in his uncle's home. He gives the coin to his sister Rachna, who is 8 year old The uncle reports the matter to the police. The police conduct a search. During the investigation the police finds the coin kept in the toys of Rachna Rachna tells the police that Sahil had given coin to her.

    A)  Sahil is guilty of theft

    Solution :

    According to the Section 83 of the Indian Penal Code, 1860, nothing is an offence which is done by a child above seven years of age and under twelve, who has not attained sufficient maturity of understanding to judge the nature and consequences of his conduct. Here, both Sahil and Rachna are below 12 years and immature enough to understand the consequences, hence, no one is guilty of theft.
