    [c] Article 123 of Indian Constitution provides for ordinance making power of President. This is one of the most important legislative power of Indian President. The ordinance can be issued to deal with any unforeseen emergency which needs immediate action when Parliament is not in session. President may issue ordinance when one House is in session because to enact a law approval of both Houses is needed. Ordinance making power of President is coterminous with legislative power of Parliament. Therefore ordinance can be promulgated to amend any tax law retrospectively. But ordinance cannot be issued by President to amend Constitution.
