    [b] NHRC is not a constitutional body, but a statutory body. It was set up under the Protection of Human Rights Act, 1993. The Chairman of NHRC has to be a retired Chief Justice of India, while the other members should be a serving or retired judge of the Supreme Court, a serving or retired Chief Justice of the High Court and two persons having knowledge and special experience with regards to human rights. The Chairman and other members of the commission are appointed by a very large committee consisting of the Prime Minister as the head along with the Speaker of the Lok Sabha, Deputy Chairman of the Rajya Sabha, Leaders of the opposition in Lok Sabha, Rajya Sabha and the Home Minister. The commission is required to inquire into the violation of human rights or the negligence of a public servant in prevention of such violation either on the receipt of a petition or court order and even suo motu if required.
