    Attorney general G E Vahanvati has said that governors have the power to act independently of the state governments in matters relating to administration in tribal dominated regions; While the governor is bound to act on the advice of the state governments, the AG has taken the view that he could act on his own when it comes to tribal areas, defined as Scheduled V (five) areas under the Constitution. In short, the Centre can implement its policies for the tribals through the governor. The AG's opinion came on a query from the home ministry and amid growing frustration in Delhi about the response of state governments to the Maoist threat and the implementation of central schemes for tribals. States with Schedule V pockets are Himachal Pradesh, Andhra Pradesh, Jharkhand, Maharashtra, Gujarat, Madhya Pradesh, Orissa, Chhattisgarh and Rajasthan. While Section 3 of Schedule V says that "the governor will make a report to the President about the administration of Scheduled Areas and the executive power of the Union shall extend to the giving of directions to states as to the administration of the said areas there has been an ambiguity about what the governor's powers mean. According to the Constitution, governors, as heads of states, function on the aid and advice of the council of ministers and it was seen to be true even in their exercise of power under Schedule V.
