An offence arising out of 'untouchability' would not made out where: ‘अस्पृश्यता’से उद्भूत अपराध गठित नहीं होगा, जबकिः

A) The act of accused with regard to the enjoyment of benefit under a charitable trust created for the benefit of any section of the general public / अभियुक्त का कार्य जनसाधारण के किसी अनुभाग के व्यक्तियों के फायदे के लिये सृष्ट एक पूर्त न्यास के अधीन फायदे के उपभोग करने के सम्बन्ध में है

B) The act of accused is with regard to the use of finery / अभियुक्त का कार्य अलंकारों के उपयोग करने के सम्बन्ध में है

C) As accused is not being competent to commit an offence / अभियुक्त के अपराध कारित करने में सक्षम होने नहीं होने से है

D) The accused and complainant victim belong to the same social group / अभियुक्त और परिवादी पीड़ित समान सामाजिक समूह से है
